By accessing or using this website, or by donating, volunteering, registering for events, or otherwise interacting with Bal Sansar Sanstha, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use this website or provide personal information.


1. Scope and Acceptance

1.1 These Terms govern your access to and use of the balsansarindia.com website (the “Site”) and any services offered on or through the Site (including donation processing, volunteer signup, event registration, downloads, mailing lists, and communications).
1.2 We may update these Terms from time to time; changes become effective when posted on the Site. We encourage you to review them periodically. Continued use after publication of changes constitutes acceptance of the updated Terms.


2. Eligibility & User Representations

2.1 You must be at least 18 years old to make donations or enter into a binding agreement through the Site. If you are younger than 18, a parent or legal guardian must provide consent.
2.2 You represent and warrant that the information you submit to us is true, accurate and complete, and that you will update it if it changes.


3. Donations — Terms, Receipts, Use of Funds

3.1 Donations may be made online via our authorised payment gateway(s) or by cheque/NEFT/transfer to our official bank account only. We will publish and maintain the details of our authorised payment partner(s) on the Site. For online collections, we typically use established payment processors (e.g. Razorpay or other approved gateway).
3.2 By making a donation, you acknowledge and agree that the donation is a voluntary contribution to Bal Sansar Sanstha and that we may apply the funds at our discretion within the stated charitable objectives of the organisation. We will always endeavour to use funds as designated by donors where such designation is accepted.
3.3 Tax Benefits / 80G: If Bal Sansar Sanstha holds tax exemption certificates (e.g., 80G / 12A), we will issue donation receipts that include the information necessary for donors to claim tax benefits. It is the donor’s responsibility to verify the NGO’s current 80G/12A status and to retain receipts for tax purposes. (Donors should consult tax advisors for personal tax treatment.)
3.4 Acknowledgement / Receipt: Donation receipts will be issued to the donor provided email or postal address within 60 days when valid details (name, PAN where required for tax benefits, email) are provided.


4. Refunds & Cancellations

4.1 Donations are ordinarily non-refundable except in limited circumstances (e.g., duplicate transaction, clear technical error, or at our sole discretion). Where refunds are permitted, they will be processed to the original payment method and may be subject to verification and deduction of applicable fees by the payment processor. Typical refund timelines may vary depending on the banking/payment instrument.


5. Volunteer Terms & Code of Conduct

5.1 By applying to volunteer, you consent to background checks or verification where required by specific programmes (for roles involving children or vulnerable groups).
5.2 Volunteers must comply with Bal Sansar Sanstha’s Volunteer Code of Conduct, which includes, but is not limited to: respect for beneficiaries, confidentiality, no alcohol/drug abuse during volunteer activities, adherence to safety rules, and professional behaviour. We reserve the right to accept, reject or terminate volunteer participation at our discretion.
5.3 Volunteers are responsible for arranging their own travel, insurance, and medical requirements unless otherwise stated for a particular programme.


6. Intellectual Property & Use of Content

6.1 The Site and its contents (text, images, logos, graphics, audio, video, designs) are the property of Bal Sansar Sanstha or our licensors and are protected by copyright, trademark and other laws.
6.2 You may not reproduce, republish, frame, download (other than for personal, non-commercial use), post, transmit or distribute any content from the Site without our prior written permission.
6.3 If you submit content (e.g. testimonials, photos, volunteer stories), you grant Bal Sansar Sanstha a perpetual, worldwide, royalty-free, transferable license to use, reproduce, publish and adapt that content for organisational and promotional purposes unless you expressly notify us otherwise in writing.


7. Website Usage, Accounts & Security

7.1 Where you register an account (if applicable), you are responsible for maintaining the confidentiality of account credentials and for all activity under your account. Notify us immediately of any unauthorised access or security breach.
7.2 We will take reasonable technical and organisational measures to protect your personal data (see our Privacy Policy), but we cannot guarantee absolute security of communications or storage. Transmission of data via the internet has inherent risks.


8. Limitation of Liability & Disclaimers

8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAL SANSAR SANSTHA, ITS OFFICERS, DIRECTORS, EMPLOYEES AND VOLUNTEERS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, DONATIONS, OR VOLUNTEER ACTIVITIES.
8.2 While we strive for accuracy, the Site and its content are provided “as is” without warranties of any kind. We do not guarantee uninterrupted access, error-free content, or the accuracy/completeness of information.
8.3 Nothing in this clause shall exclude liability for death or personal injury caused by our negligence or any other liability that cannot be excluded by law.


9. Privacy, Data Protection & Communications

9.1 Our collection and processing of personal data is governed by our Privacy Policy. We comply with applicable Indian data protection laws and principles of lawful, fair, and transparent processing. In particular, where consent is relied upon, we will obtain a clear, specific and informed consent before processing personal data. 9.2 By providing contact details, you consent to receive communications from Bal Sansar Sanstha relevant to your donation, volunteer role, event registration and organisational updates. You can opt out of marketing/updates at any time by following the unsubscribe instructions or contacting us.


10. Third-Party Links, Payment Partners & Service Providers

10.1 The Site may contain links to third-party websites. We do not control and are not responsible for third-party content or privacy practices.
10.2 We may share your personal data with third-party service providers who perform services on our behalf (payment gateways, email service providers, hosting providers, and accounting services). We will only share necessary data and require providers to maintain appropriate safeguards. Example common payment gateway partners used by Indian NGOs include Razorpay and similar services.


11. Governing Law & Dispute Resolution

11.1 These Terms will be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with the Terms shall be subject to the jurisdiction of the courts of Jaipur, Rajasthan, India.
11.2 Before initiating legal action, you and Bal Sansar Sanstha agree to attempt to resolve any dispute through good-faith negotiations.


12. Reporting Abuse or Fraud

12.1 If you suspect fraudulent activity, unauthorised use of your payment method, or misuse of the Site (e.g., impersonation of Bal Sansar Sanstha), please contact us immediately at [insert email/phone]. We will investigate and take appropriate action, including reporting to payment partners or law enforcement when necessary. Many NGOs include a warning to donors not to transfer funds to personal accounts claiming to represent the NGO.


13. Children and Minors

13.1 We do not knowingly solicit personal data from children under age 18 on the Site. If you are under 18, please do not provide personal data without parental consent. If you believe we have inadvertently collected a minor’s personal data without consent, contact us, and we will promptly remove it.

15. Miscellaneous

15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.2 These Terms, together with our Privacy Policy and any specific donation/refund policy, constitute the entire agreement between you and Bal Sansar Sanstha regarding your use of the Site.
